Fake cancer case results in $100 fine for woman | Richmond Times ...

Two 12-month jail terms for Martha Ann Nicholas were suspended.


A Mechanicsville woman accused of faking cancer to raise money pleaded guilty today to two misdemeanor charges of obtaining money by false pretenses and was fined a total of $100.

Martha Ann Nicholas was also ordered by Fredericksburg General District Judge John R. Stevens not to take part in any charitable causes and placed on five years of probation. A sentence of 12 months in jail on each charge was suspended.

Stevens accepted the plea nearly immediately and heard no evidence in the case after agreeing to the prosecution's recommendation. Stevens heard the case after Judge Robert D. Laney said he would not accept the plea agreement.

Earlier, defense attorney Sam Simpson had said that Nicholas, who had claimed at rallies that she was a cancer victim, has made restitution of $1,700, the total she had collected for herself.

Simpson also said that Nicholas had been suffering from a psychosomatic condition that led her to believe she had a cancer-like?illness, and that her soliciting donations was from a belief that she had cancer.

Her family expressed relief that she is not going to jail, and that she is receiving counseling and treatment.

(AP) ? Daniel Macias is the face of Silicon Valley seldom seen by those who don't live there.

When he was 19, he wasn't starting what would become one of the world's most successful tech companies, like Mark Zuckerberg did at that age when he founded Facebook. Macias spent his 19th birthday behind bars, where he'd been sentenced for assault.

Now 20, Macias spent a recent day learning to build houses as part of a construction job training program near Facebook's headquarters. He hopes to join the carpenters union when he finishes the program.

"If I wasn't going to school, I would have been in the streets," Macias said.

Money and jobs abound in Silicon Valley for people with the right high-tech or business skills. For those who don't, the Great Recession has meant the same challenge as anywhere else in the country.

Facebook moved into its new offices on the former campus of Sun Microsystems along San Francisco Bay not long before announcing plans for an initial public offering. Inside, employees wrestle with the enviable problem of what to do with their money once the IPO makes them overnight millionaires.

A short drive down the road, East Palo Alto saw the number of murders double from four to eight, a significant spike for a city of just 28,000 people. Average income hovers just under $18,000 annually, compared to more than $66,000 for Silicon Valley as a whole. The unemployment rate in December was 17 percent, compared to 8.3 percent region-wide.

Those disparities stem in part from the complicated histories of the small cities that span the Highway 101 corridor threading through the heart of Silicon Valley, and in part from national economic trends that have spared few struggling communities. They also reflect some changes unique to the most recent tech boom, fueled by social media, cloud computing and mobile apps.

As per capita income rises in the region, the median income has fallen, suggesting that as some people are getting richer, more are making less. The percentage of students in Silicon Valley public schools receiving free or reduced-price lunches has increased steadily over the past several years, an indication of hard times for more families.

Data on these economic trends are collected every year in the Silicon Valley Index, compiled by local nonprofit analysts. This year's report highlighted the recovery of the region's high-tech economy as wildly successful companies like Facebook go on hiring sprees.

But that recovery has not had the same ripple effect on the region as a whole compared to previous tech booms, said Russell Hancock, head of Joint Venture, one of the groups behind the index.

In the past, companies like Hewlett-Packard Co. and Lockheed Martin Corp. brought mid-level jobs to Silicon Valley along with the expected science, engineering and management positions, Hancock said. But globalization has sent the manufacturing jobs overseas. Meanwhile, information technology has made once-plentiful clerical and office positions obsolete.

"The technologies that we invented here have actually eliminated entire classes of jobs," Hancock said. Without those jobs, the prospects for workers without high-end tech skills have become even more challenging:

"If you took away tech, our region would look like any other region, maybe even worse," he said.

The contrast between the haves at Facebook and the have-nots in East Palo Alto nearby has stirred some tension. City Councilman Carlos Romero is pushing for the company to do more to address traffic and the resulting air quality issues created by the influx of new workers. He also worries that especially after Facebook's IPO, newly flush employees will start buying up the city's relatively affordable real estate close to their offices and send housing prices spiraling higher than low-income residents can afford.

"This is not about making sure that Facebook doesn't come into the community," Romero said. "This is about making sure East Palo Alto is not left out."

Nearly half of Facebook's employees take some form of alternative transportation, and the company is placing a hard cap on the number of vehicles allowed on and off campus to keep traffic down, said Facebook spokesman Tucker Bounds. Facebook has also been working with local developers on efforts to build housing for employees on vacant land near the campus to lessen the impact on the existing housing market, Bounds said.

Facebook has initiated some outreach into the surrounding community, including support for the program where Macias is learning to be a carpenter, known as JobTrain.

Kail Lubarsky, director of marketing at JobTrain, said no graduates have gotten jobs with Facebook yet, but she said she's working with the company in hopes of establishing an internship program. JobTrain has culinary arts training that could lead to jobs for students in Facebook's cafeterias. But the real goal is to place students in entry-level jobs that could let them advance to join the ranks of the in-demand coders, designers and executives who thrive most in Silicon Valley.

At JobTrain, some students said they were gunning for Facebook jobs. But many said they were simply grateful for the chance to start over, to get a foothold in an economy that has challenged many of them, even in a place where on paper the recovery is in full swing.

Macias said he sees parallels between his effort to get ahead and the Facebook employees up the road, whom he sees as average people who worked hard and succeeded.

"They took advantage of opportunities," he said.

The Pentagon has launched an investigation into the Quran burning at a US detention facility in Afghanistan. Prisoners might have used the books to pass secret messages, a spokesman says.?

The US military is now investigating whether American military officials ordered Qurans to be destroyed because prisoners at a US detention facility were passing extremist messages in them, an International Security Assistance Force spokesman said Wednesday.

?We haven?t got any proof of that yet, and that is a vital part of the investigation that is ongoing,? Brig. Gen. Carsten Jacobson said in a Pentagon briefing Wednesday.

Indeed, the entire library of the Parwan Detention Facility at Bagram Air Base, one of the largest US military facilities in Afghanistan, may have been ordered destroyed because of the extremist messages contained in texts, he added.

?It was a considerable amount of material,? General Jacobson said, though he added that he ?cannot say? if it was the ?entire? library.

There have been some 2,000 demonstrators around Bagram Air Base, as well as ?attempts to enter? the base, he said, adding that there was ?near penetration? of the base.?

There have been fatalities north and east of Kabul in demonstrations around the Quran burnings.?

?It is a grave mistake,? Jacobson told reporters in a briefing Wednesday, ?and we?re all aware of the grave implications this mistake has.?

He also acknowledged ?considerable anger? among Afghans.

Indeed, demonstrators have burned tires and thrown stones. There have also been ?shots fired,? at some of the installations, Jacobson said.

?Desecrating the Quran ? mistreating the Quran ? is a grave incident in the Muslim world. As we are not only here to protect human rights but also religious freedom ... this is a grave incident.?

Guards along the base have responded with rubber bullets, he added.

Demonstrations outside Bagram have centered on half-charred Qurans brought out by workers.

Afghan night shift workers at Bagram attempted to stop the burning of the Qurans, showed the books to their day shift colleagues, and brought the Qurans off-base.?

?That is when material left the facility,? Jacobson said.

In addition to extremist messages written on Qurans, prisoners at the US detention facility may have been circulating leaflets ?that held inflammatory material,? Jacobsen said.?

The question remains, he adds, ?How did Qurans come into this material that was then taken into the burn pit??

The investigation will also look into whether NATO officials exercised ?misjudgment,? or knowingly gave the order to destroy Qurans. ?Who basically told soldiers to take it and dispose of it in an improper way?? Jacobson said.

In response to the US military?s perhaps inadvertent burning of Qurans that has prompted two days worth of riots across the country, the commander of NATO forces in Afghanistan has promised new training for troops in the handling of religious materials.?

This training will take place over the next two weeks, says Gen. John Allen, commander of US and NATO forces. The training will include the identification of religious materials, their significance, and the correct handling and storage of such materials.

In the meantime, the mammoth challenge now is to try to convince Afghan government officials and, most importantly, the people of Afghanistan ?how sorry we are about this happening,? Jacobson said, and to ?explain that this is a mistake.??

Iranian bomb suspect retraces steps for Thai cops

Mohammad Hazaei, an Iranian national who was arrested at a Bangkok airport shortly after a series of explosions in the Thai capital on Feb. 14, faced further questioning and took part in a police re-enactment on Monday, the European Pressphoto Agency reports.

Israeli officials have said they suspect a link between blasts in Bangkok and two earlier incidents in Georgia and India. Israel accused Iran of being behind attempted attacks against its diplomats in those two countries.

Panasonic announces first smartphone for Europe - the Eluga

The device runs a lightly-skinned Android 2.3.5 Gingerbread, and is due an upgrade to Android 4.0 from "Spring 2012." NFC is also included, which will allow European buyers to use Google Wallet (when it's launched), smart tags and other services.

So it's running fairly standard mid to high-end gubbins. Panasonic's bringing some interesting hardware features to the table, though. Last spring, Weldon told shareholders at J&J's annual meeting that the company was simplifying the packaging to "help a mom, dad or caregiver ensure the correct dosing." Weldon told The Associated Press then that he thought the new design would become the industry standard.

Infants'?Tylenol?is one of the first nonprescription medicines reintroduced after all the recalls and an ongoing factory shutdown have kept most McNeil medicines off the market, some for nearly 2 years. That's cost the company well over $1 billion in lost revenue, plus many millions to rebuild one factory and upgrade others.

McNeil spokeswoman Bonnie Jacobs said it was too soon to say when the product will return to the market.

While babies are particularly vulnerable to excessive doses of medicine, J&J said there have been no reports of anyone being harmed.

The new infant?Tylenol?bottle comes with a plastic syringe that's to be inserted into the flow restrictor at the top to help measure the right dose. Consumers are to insert the tip of the syringe into the flow restrictor, turn the bottle upside down and then draw out the right dose using the milliliter markings on the syringe. LOS ANGELES (AP) ? Rescuers pulled three gunshot victims from a burning Hollywood home but found the gunman and one of his victims dead inside the structure's charred remains, authorities say.

At the height of Thursday's blaze, TV news helicopters over the scene showed officers, some with shotguns, crouching near the corner of an apartment building as firefighters trained hoses on the flames from a distance.

Other firefighters stayed behind the protection of a fire engine.

The two bodies were found after the fire was out. The three other victims ? two women and a man ? were found shot at the home when police and firefighters arrived. They were all taken to a hospital in serious condition and expected to survive.

Police believe the gunman had a relationship with one of the surviving victims. The shooting was called "domestically motivated' but authorities did not elaborate.

Neighbor Rosemary Marroquin, 25, said the people who lived in the house had moved there within the past year. She believed three couples resided there and called them friendly people.

She said there were no signs of violence, and she never heard fighting or any disturbances.

Speaking through a Spanish translator, area resident Angelica De Paz said she was about to go to a store when she saw a man kick in the front door of the house. About five minutes later, De Paz said, she got a call from a neighbor who said the house was on fire.

"I thought it was a joke," De Paz said.

She described the man she saw as being in his 20s or 30s, wearing a black shirt with blue jeans.

Area resident Darwin Urbina said he saw a man of the same description sitting on a curb outside the house shortly before he heard shots. Urbina said he and the man looked at each other.

"He had this intense look," Urbina said. "He just stared at me for a while."

Urbina said he has lived in the neighborhood for 10 years and described the area as being riddled with drugs and gang activity. He said the man had been in the area, but Urbina did not know if he lived there.

The rambling single-story home already was smoking when firefighters were called to the scene. A 34-year-old man and two 38-year-old women had been shot and police took them from the front of the home, authorities said.

The fire may have started in a detached garage at the rear of the home. Firefighters sent to the scene could only fight the surging flames from the outside. They were unable to enter the home out of concern that the gunman was still at large, fire Capt. Jaime Moore said.

In less than two hours, the fire burst through the roof and reduced most of the home to charred beams. It was so fierce that it was unlikely anyone inside survived, Moore said.

"The survivability of this fire is absolutely zero," he said.

The Fire Department had 130 firefighters on the scene, but the fire was largely allowed to burn itself out as water streams protected neighboring properties. The fire was whipped by gusty winds and an hour after it erupted the older, wooden, single-story house was a smoking ruin.

Police officers evacuated nearby buildings and established a perimeter in the neighborhood.

Japan planned review of tsunami risk, but too late (AP)

TOKYO ? Four days before a tsunami devastated a Japanese nuclear plant, its operator promised a fuller assessment of the risk of such a disaster ? but not for seven months.

The disclosure in a three-page briefing paper obtained by The Associated Press raises questions about whether the utility and regulators were too complacent about studies that suggested a tsunami could overwhelm the defenses at the 40-year-old Fukushima Dai-ichi plant.

It also highlights Japan's slow pace of decision-making on an issue that experts had been warning about for at least 20 months.

"If they had made the decision earlier, then they could have been prepared on March 11," said Hideyuki Hirakawa, an Osaka University expert on governance and the sciences. "There is absolutely nothing you can do in four days."

On March 11, 2011, a 9.0-magnitude offshore earthquake triggered a tsunami that killed about 19,000 people along Japan's northeastern coast. The surge of water knocked out power at the coastal Fukushima plant, leading to the worst nuclear disaster since Chernobyl. Tens of thousands have had to leave the area, and it's unclear whether some will ever be able to move back.

Tokyo Electric Power Co. presented the briefing paper, stamped "handle with care," at a meeting with Japan's Nuclear and Industrial Safety Agency on March 7. The agency released the document to the AP under a public records request.

The paper summarized studies that suggested a tsunami as high as 33 feet (10 meters) might hit the plant, much higher than the 20-foot (six-meter) surge it had been designed to withstand. The actual tsunami was even higher: 45 feet (14 meters).

TEPCO, as the Tokyo-based utility is commonly known, said it would review tsunami preparedness at all its plants by mid-April and present a new assessment of the Fukushima plant by October ? dates listed on the bottom of the first page under "plans for the future."

Masaru Kobayashi, who heads the agency's earthquake-safety section, said he saw the estimates for the first time at the March 7 meeting. "I told them that a speedy response was necessary, if these numbers are true," he said.

But TEPCO spokeswoman Ai Tanaka noted that the government did not order any immediate action. "None of the findings were conclusive," she added.

The report cited 2010 research at the government's National Institute of Advanced Industrial Science and Technology as saying that two to three more years would be needed to reassess the tsunami risks for northeastern Japan.

However the researcher, Yuichi Namegaya, told the AP that while more time was needed to determine the extent of the risk, the danger was evident. "The studies on a Fukushima tsunami were clear, even before my research," he said.

As early as June 2009, Yukinobu Okamura, a tsunami expert at the same government institute, warned about the need to look more closely at new evidence that a major tsunami called Jogan had hit northeastern Japan in the 9th Century.

"I would like to ask why you have not touched on this at all," Okamura demanded of a panel on nuclear regulatory policy. "I find it unacceptable."

Kobayashi, the regulator, said he called for the March 7 meeting after hearing about research on the Jogan tsunami.

He described the meeting as a polite, perfunctory affair at his agency that lasted 30, maybe 40, minutes.

The document included three diagrams. One was TEPCO's estimate of the maximum tsunami risk, based on 2002 guidelines from the Japan Society of Civil Engineers that were the government-approved standards. The other two were more recent academic projections that suggested the possibility of the higher tsunami.

Kobayashi recalled the meeting after the March 11 tsunami. "The numbers I saw were bigger than what we had earlier assessed," he said. "It had happened, and I felt bad."

LOS ANGELES ? Producer RedOne says his goal in music was to "find the next Madonna or Britney (Spears)." Then he met an unsigned artist named Lady Gaga.

The Morroco-born RedOne said he had been producing for 20 years and wanted his big break in America. He wasn't interested in working with an unknown act, but went to the studio to meet the now-famous pop star.

Fast forward four years later, the two acts are multiple Grammy winners, and up for more awards at Sunday's show.

Lady Gaga's latest album, "Born This Way," is nominated for album of the year. It's the singer's third album, and third nomination for the top Grammy prize.

"She knows a lot about music," said RedOne, born Nadir Khayat. "And we connected musically."

RedOne was just one of the hit songwriters on the BMI panel called "How I Wrote That Song" on Saturday at the Key Club in Los Angeles. He produced four songs on Lady Gaga's latest album, including the Top 10 hit "Judas." But it was "Just Dance" and "Poker Face" ? both No. 1 hits ? that set the tone for RedOne, who has also lived in Sweden.

"I had this feeling that something was there," RedOne said backstage before the event. "I've learned that anything is possible when you trust each other." The panel also included Rev Run of Run DMC, Benji and Joel Madden of Good Charlotte, RZA of Wu-Tang Clan and hip-hop producer DJ Khaled, whose hit "I'm On One" with Lil Wayne, Drake and Rick Ross is nominated for best rap/sung collaboration at the Grammys.

RedOne, who also produced hits like Jennifer Lopez's "On the Floor" and Enrique Iglesias' "I Like It," is currently working on Nicki Minaj's sophomore album.

"It's a new sound for Nicki," he said. "It's her (on) the next level. You're going to love it."
