All of the Plaintiffs named in the complaint allegedly purchased Skechers Shape-Ups toning shoes after seeing television and print advertisements touting the many health benefits of Skechers Shape-Ups. All of the Plaintiffs claim that after wearing the toning shoes for 25-45 minutes per day over a two-week period, they began wearing and using the shoes for daily activities. The lawsuit alleges the Plaintiffs sustained various injuries as a result of their use of Skechers Shape-Ups, including fractures, torn meniscus, torn ligaments and tendons, and complex regional pain syndrome.

According to the lawsuit, Skechers Shape-Ups toning shoes provide no additional health benefits than do regular athletic and walking shoes. An independent study commissioned by the American Council on Exercise concluded: ?There is simply no evidence to support the claims that these shoes will help wearers exercise more intensely, burn more calories or improve muscle strength and tone.? The lawsuit also points out that as of May 2011, Consumer Reports has documented that Skechers has seen more reports of injuries or complaints than any other product in its database.

According to Wright & Schulte LLC, this lawsuit is just one of many filed by consumers who allegedly suffered serious, debilitating injuries while wearing Skechers Shape-Ups toning shoes. In addition to complaints filed in state courts, dozens of federally filed Skechers Shape-Ups injury lawsuits are pending in a multidistrict litigation now underway in U.S. District Court, Western District of Kentucky in Louisville (MDL No. 2308). In May 2012, Skechers, USA, Inc. reached a settlement with the U.S. Federal Trade Commission (FTC) to pay $40 million to resolve charges that the company made deceptive claims about the health and fitness benefits of its toning shoes, including Skechers Shape-Ups. While purchasers of Skechers Shape-Ups will receive refunds under the agreement, consumers should be aware that the FTC?s settlement does not address injuries allegedly caused by Skechers Shape-Ups.
